These Terms of Service ("Terms") govern your use of Ridegain ("the App"), an indoor cycling training application provided by its developer, Ridegain ("we", "us"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
How the App handles your information is described separately in our Privacy Policy, which forms part of these Terms.
The App lets you run structured indoor cycling workouts, records your ride using Bluetooth sensors and smart trainers, and shows training metrics derived from your own rides. Signing in to an account is optional and is only needed for Strava integration and synchronization across your devices.
The App is currently provided free of charge. If we introduce paid features in the future, we will make the scope and price clear before you are charged. We will never charge you for access to, or use of, any third-party platform's API or for functionality provided by such a platform.
Indoor cycling is strenuous physical exercise. The App is not a medical device and does not provide medical advice. Training metrics such as FTP, TSS, and fitness/fatigue values are estimates calculated from your own recorded data and may be inaccurate. Consult a physician before beginning any training program, and stop exercising immediately if you feel unwell. You are solely responsible for your own safety and for the safe setup and operation of your trainer and equipment.
The App can connect to third-party services at your option. Strava integration is optional and is disabled until you explicitly authorize it.
Your ride records and training data belong to you. The App provides a backup export so that you can obtain your data in a machine-readable format at any time. Deleting your data is described in the Privacy Policy and on the Account Deletion page.
You agree not to: use the App in violation of any applicable law; reverse engineer, decompile, or attempt to derive the source code of the App except where such restriction is prohibited by law; interfere with or disrupt the App or the servers we or any third-party service operate; or use the App to access, collect, or redistribute another person's data without their consent.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by applicable law, we and any third-party provider whose services the App connects to, including Strava, disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the App will be uninterrupted, error-free, secure, or that any data or metric it produces will be accurate.
To the maximum extent permitted by applicable law, neither we nor any third-party provider whose services the App connects to, including Strava, shall be liable for any indirect, incidental, special, punitive, or consequential damages, or for any loss of use, data, business, profits, or goodwill, arising out of or in connection with your use of or inability to use the App, however caused and on any theory of liability, even if advised of the possibility of such damages.
To the extent liability cannot lawfully be excluded, our total aggregate liability arising out of or relating to the App shall not exceed the greater of the amount you paid us for the App in the twelve months preceding the claim, or JPY 1,000.
Some jurisdictions do not allow certain exclusions or limitations, so parts of Sections 7 and 8 may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
You may stop using the App at any time by uninstalling it, and you may delete your account and server-side data from within the App. We may suspend or terminate the App, or your access to it, if you materially breach these Terms or if we discontinue the App. Sections 5, 7, 8, and 10 survive termination.
We may update these Terms. The current version is always published at this URL with its "Last updated" date. If a change is material, we will make reasonable efforts to notify you in the App. Continuing to use the App after a change takes effect means you accept the updated Terms.
These Terms are governed by the laws of Japan, excluding its conflict-of-laws rules. The Sapporo District Court shall have exclusive jurisdiction of first instance over any dispute arising out of or relating to these Terms. If you are a consumer resident in a jurisdiction whose mandatory consumer-protection law grants you the right to bring proceedings in your place of residence, this section does not deprive you of that right.
